I think this falls within the general area of model and property/subject 
release.  If your work portrays the work or property of another and it can be 
identified in your work, then you very well might need a release from the owner 
of that other work or property in order to commercially use it.  One well known 
situation may be found in the famous cypress on the coast between Monterey and 
Carmel: the owners of the property reportedly vigorously pursue and constrain 
use by those who photograph and attempt to commercially use an image of that 
tree.
